عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنِ الزُّهْرِيِّ،
فِي رَجُلٍ عَضَّ رَجُلًا فَشَلَّتْ إِصْبَعُهُ قَالَ: " يَقْتَصُّ صَاحِبُهُ، فَإِنْ شَلَّتْ فَقَدِ اسْتَكْمَلَ الْقَوَدَ، وَإِنْ لَمْ تَشَلَّ غَرِمَ لَهُ صَاحِبُهُ دِيَةَ إِصْبَعِهِ الَّتِي شَلَّتْ، فَإِنْ شَلَّتْ يَدُ الَّذِي اسْتُقِيدَ مِنْهُ بِمَا أَصَابَ فَفِي ذَلِكَ الْعَقْلُ، وَإِنْ بَلَغَ النَّفْسَ لِأَنَّ اللهَ هُوَ الَّذِي أَمَرَ بِالْقَوَدِ، وَلَيْسَ عَلَى الْمُسْتَقِيدِ فِي فَرْضٍ أَصَابَهُ إِلَّا الْعَقْلُ لَيْسَ عَلَيْهِ الْقَوَدُ، فَإِنْ كَانَ مَنْ يَسْتَقِيدُ عَدَا فَوْقَ حَدِّهِ فَعَدَاؤُهُ ذَلِكَ قَوَدٌ
