عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
فِي عَبْدٍ كُوتِبَ عَلَى أَلْفِ دِرْهَمٍ فَمَاتَ سَيِّدُهُ وَأَوْصَى بِخَمْسِينَ دِرْهَمًا مِنْ كِتَابَتِهِ، وَأَعْتَقَ رَقِيقًا وَأَوْصَى بِوَصَايَا " قَالَ: " لَا يُبَاعُ الْمُكَاتِبُ وَلَا يُقَوَّمُ وَيَبِيعُ كُلُّ إِنْسَانٍ الْمُكَاتِبَ بِحِصَّتِهِ، وَيَضْرِبُ الْمُكَاتِبُ بِمَا أَوْصَى لَهُ مَعَهُمْ إِلَّا أَنَّهُ يَبْدَأُ بِالْعِتْقِ
