عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
إِذَا أَوْصَى الرَّجُلُ بِوَصِيَّةٍ، ثُمَّ رَدَّهَا قَبْلَ أَنْ يَمُوتَ الْمُوصِي فَلَيْسَ رَدُّهُ بِشَيْءٍ، يَرْجِعُ فِيهَا إِنْ شَاءَ لِأَنَّهُ رَدَّ شَيْئًا لَمْ يَقَعْ لَهُ بَعْدُ، وَإِنْ رَدَّهُ بَعْدَ مَوْتِ الْمُوصِي فَقَدْ مَضَى الرَّدُّ وَلَيْسَ لَهُ أَنْ يَرْجِعَ فِيهِ، وَإِنْ مَاتَ الْمُوصَى لَهُ بَعْدَ مَوْتِ الْمُوصِي فَقَالَ وَرَثَةُ الْمُوصَى لَهُ: لَا نَقْبَلُهَا، فَلَيْسَ بِرَدٍّ؛ لِأَنَّ الْوَصِيَّةَ لَمْ تَكُنْ لَهُمْ وَإِنَّمَا كَانَ مَالٌ وَرِثُوهُ
