عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
لَوْ أَنَّ إِنْسَانًا، أَوْصَى لِأُمِّهِ وَهِيَ أُمُّ وَلَدٍ لِأَبِيهِ أَوْ لِأُمِّ وَلَدِ ابْنِهِ بِوَصِيَّةٍ لَمْ يَجُزْ؛ لِأَنَّهَا مَمْلُوكَةٌ لِابْنِهِ وَالْمِيرَاثُ يَرْجِعُ لِلْوَارِثِ
