عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي امْرَأَةٍ وَرِثَتْ مُكَاتَبًا لَهَا مِنْ أَبِيهَا هِيَ وَأَخُوهَا فَأَعْتَقَا الْمُكَاتَبَ، قَالَ: " الْوَلَاءُ لِلْأَخِ، إِنَّمَا وَرِثَتْ دَرَاهِمَ " قَالَ: وَنَحْنُ عَلَى ذَلِكَ، قَالَ: " وَلَوْ أَنَّ الْمَرْأَةَ أَعْتَقَتْ نَصِيبَهَا مِنَ الْمُكَاتَبِ، فَلَا ضَمَانَ عَلَيْهَا، وَإِنْ عَجَزَ رُدَّ فِي الرِّقِّ لِأَنَّهَا إِنَّمَا تَرَكَتْ دَرَاهِمَ، وَيَصِيرُ لَهَا نَصِيبًا مِنْ ذَلِكَ الْمُكَاتَبِ، لَا يَنْفَعُ عِتْقُهَا
