عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ قَالَ:
إِذَا كَانَ عَبْدٌ بَيْنَ رَجُلَيْنِ، فَكَاتَبَهُ أَحَدُهُمَا بِغَيْرِ إِذْنِ شَرِيكِهِ، فَإِذَا أَدَّى الَّذِي كَاتَبَ عَلَيْهِ، كَانَ هَذَا شَرِيكَهُ فِيمَا أَخَذَ مِنْهُ، وَعَتَقَ الْعَبْدُ، وَضَمِنَ الَّذِي كَاتَبَ نَصِيبَ الْآخَرِ، فَإِنْ كَانَ لِلَّذِي كَاتَبَ وَفَاءٌ أَخَذَ مِنْهُ، وَإِنْ لَمْ يَكُنْ لَهُ وَفَاءٌ سَعَى الْعَبْدُ فِي نِصْفِ قِيمَتِهِ، وَصَارَ شَرِيكَهُ فِيمَا أَخَذَ مِنْ كِتَابَتِهِ
