عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي رَجُلَيْنِ بَيْنَهُمَا عَبْدٌ، فَأَذِنَ أَحَدُهُمَا لِلْآخَرِ فِي أَنْ يُكَاتِبَ نَصِيبَهُ، ثُمَّ إِنَّ الْآخَرَ أَعْتَقَ قَالَ: " تُرْجَأُ الْعَتَاقَةُ حَتَّى يَنْظُرَ مَا يَصْنَعُ الْعَبْدُ، فَإِنْ عَجَزَ ضَمِنَ الْمُعْتِقُ، وَإِنْ أَدَّى الْكِتَابَةَ ضَمِنَ الَّذِي كَاتَبَ لِلَّذِي أَعْتَقَ
