أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا مَعْمَرٌ، عَنْ قَتَادَةَ قَالَ:
سَأَلَنِي سُلَيْمَانُ بْنُ هِشَامٍ، وَالزُّهْرِيُّ عَنْ عَبْدٍ أَعْتَقَ أَحَدُهُمْ وَكَاتَبَ أَحَدُهُمْ وَأَمْسَكَ أَحَدُهُمْ، فَقَالَ الزُّهْرِيُّ: " لَيْسَ لِلَّذِي أَعْتَقَ مِنْ مِيرَاثِهِ شَيْءٌ، هُوَ لِلَّذِي أَمْسَكَ وَلِلَّذِي كَاتَبَ بَيْنَهُمَا شَطْرَيْنِ "، قَالَ قَتَادَةُ: وَقُلْتُ أَنَا: " إِنْ كَانَتِ الْمُكَاتَبَةُ بَعْدَ الْعِتْقِ فَلَيْسَتْ بِشَيْءٍ، وَإِنْ كَانَتْ قَبْلَ الْعِتْقِ فَإِنَّ لِلَّذِي أَمْسَكَ ثُلُثَ ثَمَنِهِ عَلَى الَّذِي أَعْتَقَ، وَيَكُونُ الثُّلُثَانِ مِنَ الْوَلَاءِ لِلْمُعْتِقِ، وَالثُّلُثُ لِلَّذِي كَاتَبَ
