If a man gives another man a thousand dirhams as a partnership investment (muḍārabah), and he buys a slave woman with it, and she pleases him, so he has intercourse with her and she bears him a child, she is to be valued. If her value exceeds a thousand dirhams, we make him liable for the value of the slave woman, and we deduct from him his share of the slave woman, because he has a share in her, and the child is his. But if there is no surplus in her value, then he owes the dowry-equivalent ('uqr), and the ḥadd punishment is averted from him because of doubt, and the child is the property of the owner of the capital, because he had intercourse with her and has no share in her.
