أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: قَالَ الثَّوْرِيُّ:
إِذَا قُلْتَ: أَبِيعُكَ بِالنَّقْدِ إِلَى كَذَا، وَبِالنَّسِيئَةِ بِكَذَا وَكَذَا، فَذَهَبَ بِهِ الْمُشْتَرِي - فَهُوَ بِالْخِيَارِ فِي الْبَيْعَيْنِ مَا لَمْ يَكُنْ وَقَعَ بَيْعٌ عَلَى أَحَدِهِمَا. فَإِنْ وَقَعَ الْبَيْعُ هَكَذَا فَهَذَا مَكْرُوهٌ، وَهُوَ بَيْعَتَانِ فِي بَيْعَةٍ، وَهُوَ مَرْدُودٌ، وَهُوَ الَّذِي يُنْهَى عَنْهُ؛ فَإِنْ وَجَدْتَ مَتَاعَكَ بِعَيْنِهِ أَخَذْتَهُ، وَإِنْ كَانَ قَدِ اسْتُهْلِكَ فَلَكَ أَوْكَسُ الثَّمَنَيْنِ وَأَبْعَدُ الْأَجَلَيْنِ
