عَبْدُ الرَّزَّاقِ عَنِ الثَّوْرِيِّ قَالَ:
إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ، فَجَعَلَ عِتْقَهَا صَدَاقَهَا سَعَتْ لَهُ فِي نِصْفِ قِيمَتِهَا إِذَا طَلَّقَهَا قَبْلَ أَنْ يُجَامِعَهَا. فِي قَوْلِ مَنْ قَالَ: " عِتْقُهَا صَدَاقُهَا ". وَفِي قَوْلِ مَنْ قَالَ: " لَا يَكُونُ نِكَاحًا أَنْ يَجْعَلَ عِتْقَهَا صَدَاقَهَا، فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا سَعَتْ فِي قِيمَتِهَا "
