عَبْدُ الرَّزَّاقِ عَنِ الثَّوْرِيِّ، عَنْ رَجُلٍ كَانَ أَجِيرًا لِسَالِمِ بْنِ عَبْدِ اللهِ، عَنْ سَالِمِ بْنِ عَبْدِ اللهِ قَالَ: قَالَ عُمَرُ:
إِذَا نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوَالِيهِ، فَنِكَاحُهُ حَرَامٌ، وَإِذَا نَكَحَ بِإِذْنِ مَوَالِيهِ، فَالطَّلَاقُ بِيَدَيْ مَنْ يَسْتَحِلُّ الْفَرْجَ
