عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ قَتَادَةَ،
فِي رَجُلٍ حَلَفَ بِطَلَاقِ امْرَأَتِهِ ثَلَاثًا أَنْ لَا يَقْرَبَهَا سَنَةً، قَالَ: فَقَالَ قَتَادَةُ: كَانَ الْحَسَنُ يَقُولُ: " إِذَا مَضَتِ الْأَشْهُرُ فَقَدْ بَانَتْ مِنْهُ، فَإِنْ تَزَوَّجَهَا بَعْدَ ذَلِكَ فَلَيْسَ عَلَيْهِ إِيلَاءٌ، قَدْ هَدَمَهُ الطَّلَاقُ وَالنِّكَاحُ "، قَالَ: قُلْتُ: أَدِّهِ، قَالَ أَبُو الشَّعْثَاءِ: " إِذَا مَضَتِ الْأَشْهُرُ فَقَدْ بَانَتْ مِنْهُ، فَإِنْ تَزَوَّجَهَا بَعْدَ ذَلِكَ فَلَيْسَ عَلَيْهِ إِيلَاءٌ، وَلَكِنَّهُ لَا يَقْرَبُهَا حَتَّى تَمْضِيَ السَّنَةُ، فَإِنْ مَسَّهَا حَنِثَ فِي يَمِينِهِ "، قَالَ مَعْمَرٌ: وَبَلَغَنِي عَنْ إِبْرَاهِيمَ أَنَّهُ قَالَ: " تَزَوَّجَهَا بَعْدَ ذَلِكَ فَقَدْ وَقَعَ الْإِيلَاءُ
