عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ
فِي رَجُلٍ حَلَفَ أَنْ لَا يَقْرَبَ امْرَأَتَهُ فِي هَذِهِ السَّنَةِ إِلَّا مَرَّةً، فَجَامَعَهَا بَعْدَ أَشْهُرٍ، وَقَدْرُ مَا يَكُونُ بَيْنَهُ وَبَيْنَ وُقُوعِهِ عَلَيْهَا، وَبَيْنَ تَمَامِ السَّنَةِ أَكْثَرُ مِنْ أَرْبَعَةِ أَشْهُرٍ " وَقَعَ عَلَيْهِ الْإِيلَاءُ حِينَ يُجَامِعُهَا، فَإِنْ كَانَ لَيْسَ بَيْنَهُ وَبَيْنَ تَمَامِ السَّنَةِ إِلَّا أَقَلُّ مِنْ أَرْبَعَةِ أَشْهُرٍ لَمْ يَقَعْ عَلَيْهِ الْإِيلَاءُ، أَلَا إِنَّ الْإِيلَاءَ إِنَّمَا يَقَعُ حِينَ يُجَامِعُهَا
