✧ Inheritance of the apostate

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ قَالَ: أَخْبَرَنَا الثَّوْرِيُّ:
فِي الْمُرْتَدِّ إِذَا قُتِلَ فَمَالُهُ لِوَرَثَتِهِ، وَإِذَا لَحِقَ بِأَرْضِ الْحَرْبِ فَمَالُهُ لِلْمُسْلِمِينَ، لَا أَعْلَمُهُ إِلَّا قَالَ: " إِلَّا أَنْ يَكُونَ لَهُ وَارِثٌ عَلَى دِينِهِ فِي أَرْضٍ فَهُوَ أَحَقُّ بِهِ
Translation
✧ Concerning an apostate: if he is killed, his wealth belongs to his heirs; and if he joins the territory of war, his wealth belongs to the Muslims. I do not know whether he added: "unless he has an heir of the same religion in the territory, who is more entitled to it."
