✧ No hadd punishment upon one who throws at them

أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنِ الثَّوْرِيِّ، عَنْ طَارِقِ بْنِ عَبْدِ الرَّحْمَنِ، وَمُطَرِّفِ بْنِ طَرِيفٍ، قَالَا:
كُنَّا عِنْدَ الشَّعْبِيِّ، فَرُفِعَ إِلَيْهِ رَجُلَانِ مُسْلِمٌ وَنَصْرَانِيٌّ، قَذَفَ كُلُّ وَاحِدٍ مِنْهُمَا صَاحِبَهُ، فَضَرَبَ النَّصْرَانِيَّ لِلْمُسْلِمِ ثَمَانِينَ. وَقَالَ لِلنَّصْرَانِيِّ: لَمَا فِيكَ أَعْظَمُ مِنْ قَذْفِ هَذَا ! فَتَرَكَهُ. فَرُفِعَ ذَلِكَ إِلَى عَبْدِ الْحَمِيدِ بْنِ زَيْدٍ، فَكَتَبَ فِيهِ إِلَى عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، فَذَكَرَ مَا صَنَعَ الشَّعْبِيُّ، فَكَتَبَ عُمَرُ يُحَسِّنُ مَا صَنَعَ الشَّعْبِيُّ
Translation
✧ We were with al-Sha'bi, and two men were brought to him, a Muslim and a Christian, each of whom had slandered his companion. He struck the Christian eighty lashes on behalf of the Muslim, and said to the Christian: "What is in you is greater than this one's slander!" So he left him. Then that was raised to 'Abd al-Hamid b. Zayd, and he wrote about it to 'Umar b. 'Abd al-'Aziz, and mentioned what al-Sha'bi had done. 'Umar wrote commending what al-Sha'bi had done.
