أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ،
عَنِ الزُّهْرِيِّ: ﴿فَاحْكُمْ بَيْنَهُمْ أَوْ أَعْرِضْ عَنْهُمْ ﴾قَالَ: مَضَتِ السُّنَّةُ أَنْ يُرَدُّوا فِي حُقُوقِهِمْ وَمَوَارِيثِهِمْ إِلَى أَهْلِ دِينِهِمْ، إِلَّا أَنْ يَأْتُوا رَاغِبِينَ فِي حَدٍّ نَحْكُمُ بَيْنَهُمْ فِيهِ، فَنَحْكُمُ بَيْنَهُمْ بِكِتَابِ اللهِ، وَقَدْ قَالَ اللهُ عَزَّ وَجَلَّ لِرَسُولِهِ ﷺ: ﴿وَإِنْ حَكَمْتَ فَاحْكُمْ بَيْنَهُمْ بِالْقِسْطِ ﴾
Translation
✧ From al-Zuhri: 'So judge between them or turn away from them' (Q. 5:42). He said: The sunna has passed that they be returned in their rights and inheritances to the people of their religion, unless they come willingly for a hadd, in which case we judge between them, and we judge between them by the Book of Allah. Allah, Mighty and Majestic, said to His Messenger ﷺ: 'And if you judge, judge between them with justice' (Q. 5:42).
