✧ Al-Qaʿnabī narrated to us; (Ḥ) and Bakr b. Sahl al-Dimyāṭī narrated to us; ʿAbdullāh b. Yūsuf narrated to us, all of them from Mālik, from Yaḥyā b. Saʿīd, from Muḥammad b. Yaḥyā b. Ḥabbān: A slave stole a small palm shoot from the walled garden of a man and put it in the walled garden of his master. The owner of the shoot went out looking for his shoot and seized it, then he sought help against the slave from Marwān b. al-Ḥakam. Marwān imprisoned the slave and wanted to amputate his hand. The slave’s master went to Rāfiʿ b. Khadīj and asked him about that, and he informed him that he heard the Messenger of God ﷺ say: “There is no amputation for fruit, nor for palm pith.”
