حَدَّثَنَا مُحَمَّدُ بْنُ النَّضْرِ الْأَزْدِيُّ ثنا أَحْمَدُ بْنُ عَبْدِ الْمَلِكِ بْنِ وَاقِدٍ الْحَرَّانِيُّ ثنا أَيُّوبُ بْنُ سُلَيْمَانَ الْحوزيُّ قَالَ سَأَلْتُ عَطَاءَ بْنَ أَبِي رَبَاحٍ عَنْ رَجُلٍ ذَكَرَ امْرَأَةً فَقَالَ يَوْمَ أَتَزَوَّجُهَا فَهِيَ طَالِقٌ الْبَتَّةَ فَقَالَ
عَطَاءٌ «لَا طَلَاقَ لِمَنْ لَا يَمْلِكُ عُقْدَتَهُ وَلَا عِتْقَ لِمَنْ لَا يَمْلِكُ رَقَبَتَهُ» ذَكَرَ ذَلِكَ عَنِ ابْنِ عَبَّاسٍ وَأَسْنَدَهُ إِلَى النَّبِيِّ ﷺ

✧ ʿAtaʾ said: "There is no divorce for one who does not possess the authority to dissolve his marriage, and no emancipation for one who does not own the slave," mentioning that from Ibn ʿAbbas and attributing it to the Prophet ﷺ.
