✧ Abdullah b. Ayyub al-Qurubi

حَدَّثَنَا عَبْدُ اللهِ بْنُ أَيُّوبَ الْقِرَبِيُّ قَالَ: نَا مُحَمَّدُ بْنُ سُلَيْمَانَ الذُّهْلِيُّ قَالَ: نَا عَبْدُ الْوَارِثِ بْنُ سَعِيدٍ قَالَ:

قَدِمْتُ مَكَّةَ فَوَجَدْتُ بِهَا أَبَا حَنِيفَةَ، وَابْنَ أَبِي لَيْلَى، وَابْنَ شُبْرُمَةَ، فَسَأَلْتُ أَبَا حَنِيفَةَ، قُلْتُ: مَا تَقُولُ فِي رَجُلٍ بَاعَ بَيْعًا وَشَرَطَ شَرْطًا ؟ قَالَ: " الْبَيْعُ بَاطِلٌ، وَالشَّرْطُ بَاطِلٌ "، ثُمَّ أَتَيْتُ ابْنَ أَبِي لَيْلَى، فَسَأَلْتُهُ، فَقَالَ: " الْبَيْعُ جَائِزٌ، وَالشَّرْطُ بَاطِلٌ "، ثُمَّ أَتَيْتُ ابْنَ شُبْرُمَةَ، فَسَأَلْتُهُ، فَقَالَ: " الْبَيْعُ جَائِزٌ، وَالشَّرْطُ جَائِزٌ "، فَقُلْتُ: يَا سُبْحَانَ اللهِ، ثَلَاثَةٌ مِنْ فُقَهَاءِ الْعِرَاقِ اخْتَلَفْتُمْ عَلَيَّ فِي مَسْأَلَةٍ وَاحِدَةٍ

Translation

✧ I came to Makkah and found Abu Hanifah, Ibn Abi Layla, and Ibn Shubrumah there. I asked Abu Hanifah, saying: “What do you say about a man who made a sale and stipulated a condition?” He said: “The sale is invalid and the condition is invalid.” Then I came to Ibn Abi Layla and asked him, and he said: “The sale is valid and the condition is invalid.” Then I came to Ibn Shubrumah and asked him, and he said: “The sale is valid and the condition is valid.” I said: “Glory be to God! Three jurists of Iraq have differed before me on a single issue.”
