أَخْبَرَنَا هِلَالُ بْنُ بِشْرٍ قَالَ حَدَّثَنَا أَبُو عَبْدِ الصَّمَدِ عَنْ عَطَاءِ بْنِ السَّائِبِ عَنْ أَبِي ظَبْيَانَ قَالَ

أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ زَنَتْ وَمَعَهَا وَلَدُهَا فَمَرَّ عَلِيٌّ فَخَلَّى سَبِيلَهَا وَقَالَ هَذِهِ مُبْتَلَاةُ بَنِي فُلَانٍ ثُمَّ قَالَ وَاللهِ لَقَدْ عَلُمْتُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ عَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ وَعَنِ الْمُبْتَلَى حَتَّى يَعْقِلَ وَعَنِ الصَّغِيرِ حَتَّى يَبْلُغَ يُكْبُرَ»

Translation

✧ A woman who had committed adultery was brought to ʿUmar, and with her was her child. ʿAlī passed by and let her go, saying: “This is an afflicted woman of the Banū [such-and-such].” Then he said: “By Allah, I know that the Messenger of Allah ﷺ said: ‘The pen is lifted from three: from the sleeper until he wakes, from the afflicted one until he regains his intellect, and from the young child until he reaches maturity and grows up.’”
