أَخْبَرَنَا أَحْمَدُ بْنُ سُلَيْمَانَ قَالَ حَدَّثَنَا يَزِيدُ قَالَ حَدَّثَنَا سُفْيَانُ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ عَنْ عَبْدِ اللهِ

أَنَّهُ أَتَى فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَمَاتَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا وَلَمْ يَدْخُلْ بِهَا فَاخْتَلَفُوا إِلَيْهِ قَرِيبًا مِنْ شَهْرٍ لَا يُفْتِيهِمْ ثُمَّ قَالَ أَرَى لَهَا صَدَاقَ نِسَائِهَا لَا وَكْسَ وَلَا شَطَطَ وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ أَنَّ رَسُولَ اللهِ ﷺ «قَضَى فِي بِرْوَعِ بِنْتِ وَاشِقٍ بِمِثْلِ مَا قَضَيْتَ» [223] 5491 وَعَنْ إِسْحَاقَ بْنِ إِبْرَاهِيمَ عَنِ الْمُعْتَمِرِ بْنِ سُلَيْمَانَ عَنْ مَنْصُورٍ بِهِ

✧ A man came to him about a woman whom a man had married and then died without having assigned her a dowry and without having consummated the marriage with her. They kept coming to him for nearly a month and he did not give them a ruling. Then he said, “I think she should have a dowry like that of her peers, without reduction or excess, and she inherits, and she must observe the waiting period.” Then Maqil b. Sinan al-Ashjai testified that the Messenger of Allah ﷺ “ruled in the case of Birwa bint Washiq with the like of what you have ruled.” [223] 5491 And from Ishaq b. Ibrahim from al-Mutamir b. Sulayman from Mansur with it.
