أَخْبَرَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى وَسُلَيْمَانُ بْنُ دَاوُدَ عَنِ ابْنِ وَهْبٍ أَخْبَرَنِي يُونُسُ عَنِ ابْنِ شِهَابٍ قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ أَنَّهُ سَأَلَ عَائِشَةَ

عَنْ قَوْلِ اللهِ ﷻ {وَإِنْ خِفْتُمْ أَلَّا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} [النساء 3] قَالَتْ يَا ابْنَ أُخْتِي هِيَ الْيَتِيمَةُ تَكُونُ فِي حِجْرِ وَلِيِّهَا فَتُشَارِكُهُ فِي مَالِهِ فَيُعْجِبُهُ مَالُهَا وَجَمَالُهَا فَيُرِيدُ وَلِيُّهَا أَنْ يَتَزَوَّجَهَا بِغَيْرِ أَنْ يُقْسِطَ فِي صَدَاقِهَا فَيُعْطِيَهَا مِثْلَ مَا يُعْطِيهَا غَيْرُهُ فَنُهُوا أَنْ يُنْكِحُوهُنَّ إِلَّا أَنْ يُقْسِطُوا لَهُنَّ وَيَبْلُغُوا بِهِنَّ أَعَلَى سُنَّتِهِنَّ مِنَ الصَّدَاقِ فَأُمِرُوا أَنْ يَنْكِحُوا مَا طَابَ لَهُمْ مِنَ النِّسَاءِ سِوَاهُنَّ قَالَ عُرْوَةُ قَالَتْ عَائِشَةُ ثُمَّ إِنَّ النَّاسَ اسْتَفْتَوْا رَسُولَ اللهِ ﷺ بَعْدُ فِيهِنَّ فَأَنْزَلَ اللهُ {وَيَسْتَفْتُونَكَ فِي النِّسَاءِ قُلِ اللهُ يُفْتِيكُمْ فِيهِنَّ} [النساء 127] إِلَى قَوْلِهِ {وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ} [النساء 127] قَالَتْ عَائِشَةُ وَالَّذِي ذَكَرَ اللهُ تَعَالَى أَنَّهُ يُتْلَى فِي الْكِتَابِ الْآيَةُ الْأُولَى الَّتِي فِيهَا {وَإِنْ خِفْتُمْ أَنْ لَا تُقْسِطُوا فِي الْيَتَامَى فَانْكِحُوا مَا طَابَ لَكُمْ مِنَ النِّسَاءِ} قَالَتْ عَائِشَةُ وَقَوْلُ اللهِ فِي الْآيَةِ الْأُخْرَى {وَتَرْغَبُونَ أَنْ تَنْكِحُوهُنَّ} [النساء 127] رَغْبَةَ أَحَدِكُمْ عَنْ يَتِيمَتِهِ الَّتِي تَكُونُ فِي حِجْرِهِ حِينَ تَكُونُ قَلِيلَةَ الْمَالِ وَالْجَمَالِ فَنُهُوا أَنْ يَنْكِحُوا مَا رَغِبُوا فِي مَالِهَا مِنْ يَتَامَى النِّسَاءِ إِلَّا بِالْقِسْطِ مِنْ أَجْلِ رَغْبَتِهِمْ عَنْهُنَّ

✧ About the saying of Allah ﷻ {And if you fear that you will not deal justly with the orphan girls, then marry those that please you of women} [al-Nisa 3], she said, “O son of my sister, this is about the orphan girl who is in the care of her guardian and shares in his wealth, and her wealth and beauty please him, so her guardian wants to marry her without being just in her dowry, giving her the like of what another would give her. They were forbidden to marry them unless they deal justly with them and give them the highest of their customary dowries. So they were commanded to marry other women who please them besides them.” Urwah said: Aishah said, “Then the people later sought a ruling from the Messenger of Allah ﷺ concerning them, so Allah revealed {And they seek your ruling concerning women. Say: Allah gives you a ruling about them} [al-Nisa 127] up to His saying {and you desire to marry them} [al-Nisa 127].” Aishah said, “And what Allah, the Exalted, mentioned that is recited in the Book is the first verse in which is {And if you fear that you will not deal justly with the orphan girls, then marry those that please you of women}.” Aishah said, “And the saying of Allah in the other verse {and you desire to marry them} [al-Nisa 127] refers to the desire of one of you to turn away from his orphan girl who is in his care when she has little wealth and beauty. They were forbidden to marry those orphan women whose wealth they desired except with justice, because of their desire to turn away from them.”
