al-Sunan al-Kubra (al-Nasa'i) 5335

✧ The prohibition of a man proposing to his brother's fiancée if the woman agrees, whether she is previously married, or by remaining silent if she is unmarried.

أَخْبَرَنِي هَارُونُ بْنُ عَبْدِ اللهِ الْحَمَّالُ قَالَ حَدَّثَنَا مَعْنٌ قَالَ حَدَّثَنَا مَالِكٌ وَالْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ عَنِ ابْنِ الْقَاسِمِ قَالَ حَدَّثَنِي مَالِكٌ عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ عَنِ الْأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ

أَنَّ رَسُولَ اللهِ ﷺ قَالَ «لَا يَخْطُبُ أَحَدُكُمْ عَلَى خِطْبَةِ أَخِيهِ»
