أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ عَنْ جَرِيرٍ عَنْ هِشَامِ بْنِ عُرْوَةَ عَنْ أَبِيهِ عَنْ عَائِشَةَ قَالَتْ

كَاتَبَتْ بَرِيرَةُ عَلَى نَفْسِهَا بِتِسْعِ أَوَاقٍ فِي كُلِّ سَنَةٍ أُوقِيَّةٌ فَأَتَتْ عَائِشَةَ تَسْتَعِينُهَا فَقَالَتْ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا لَهُمْ عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَهَبَتْ بَرِيرَةُ فَكَلَّمَتْ بِذَلِكَ أَهْلَهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَجَاءَتْ إِلَى عَائِشَةَ وَجَاءَ رَسُولُ اللهِ ﷺ عِنْدَ ذَلِكَ فَقَالَتْ لَهَا مَا قَالَ أَهْلُهَا فَقَالَتْ لَاهَا اللهُ إِذَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لِي فَقَالَ رَسُولُ اللهِ ﷺ «مَا هَذَا؟» فَقُلْتُ يَا رَسُولَ اللهِ إِنَّ بَرِيرَةَ أَتَتْنِي تَسْتَعِينُ بِي عَلَى كِتَابَتِهَا فَقُلْتُ لَا إِلَّا أَنْ يَشَاءُوا أَنْ أَعُدَّهَا عَدَّةً وَاحِدَةً وَيَكُونُ الْوَلَاءُ لِي فَذَكَرَتْ ذَلِكَ لِأَهْلِهَا فَأَبَوْا عَلَيْهَا إِلَّا أَنْ يَكُونَ الْوَلَاءُ لَهُمْ فَقَالَ رَسُولُ اللهِ ﷺ «ابْتَاعِيهَا وَاشْتَرِطِي لَهُمُ الْوَلَاءَ فَإِنَّ الْوَلَاءَ لِمَنْ أَعْتَقَ» ثُمَّ قَامَ فَخَطَبَ النَّاسَ فَحَمِدَ اللهَ وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ «مَا بَالُ أَقْوَامٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَ فِي كِتَابِ اللهِ يَقُولُونَ أُعْتِقُ فُلَانًا وَالْوَلَاءُ لِي كِتَابُ اللهِ أَحَقُّ وَشَرْطُ اللهِ أَوْثَقُ وَكُلُّ شَرْطٍ لَيْسَ فِي كِتَابِ اللهِ فَهُوَ بَاطِلٌ وَإِنْ كَانَ مِائَةَ شَرْطٍ» فَخَيَّرَهَا رَسُولُ اللهِ ﷺ مِنْ زَوْجِهَا وَكَانَ عَبْدًا فَاخْتَارَتْ نَفْسَهَا قَالَ عُرْوَةُ وَلَوْ كَانَ حُرًّا مَا خَيَّرَهَا رَسُولُ اللهِ ﷺ

✧ Barirah entered into a kitabah contract for her freedom for nine uqiyyahs, one uqiyyah each year. She came to Aisha seeking her help. Aisha said: "No, unless they agree that I pay them the sum in one lump payment and the wala' is mine." Barirah went and spoke to her owners about that, but they refused unless the wala' was theirs. She came back to Aisha, and the Messenger of Allah ﷺ came at that moment. Aisha told her what her owners had said, and she said: "No, by Allah, unless the wala' is mine." The Messenger of Allah ﷺ said: "What is this?" I said: "O Messenger of Allah, Barirah came to me seeking my help with her kitabah, and I said: No, unless they agree that I pay them the sum in one lump payment and the wala' is mine. She mentioned that to her owners, but they refused unless the wala' was theirs." The Messenger of Allah ﷺ said: "Buy her and stipulate the wala' for them, for the wala' belongs to the one who frees." Then he stood and addressed the people. He praised and extolled Allah, then said: "What is the matter with people who stipulate conditions that are not in the Book of Allah? They say: 'Free so-and-so and the wala' is mine.' The Book of Allah is more deserving, and the condition of Allah is more binding. Every condition that is not in the Book of Allah is invalid, even if it is a hundred conditions." Then the Messenger of Allah ﷺ gave her the choice regarding her husband, who was a slave, and she chose herself. Urwah said: "If he had been free, the Messenger of Allah ﷺ would not have given her the choice."
