أَخْبَرَنَا مُحَمَّدُ بْنُ يَحْيَى عَنْ عَبْدِ الْأَعْلَى ثُمَّ ذَكَرَ كَلِمَةً مَعْنَاهَا حَدَّثَنَا سَعِيدٌ عَنْ قَتَادَةَ عَنْ عُمَرَ بْنِ الْخَطَّابِ قَالَ

«مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ» وَكَانَ قَتَادَةُ يَأْخُذُ بِهِ وَعَنْ قَتَادَةَ أَنَّ الْحَسَنَ وَجَابِرَ بْنَ زَيْدٍ قَالَا «مَنْ مَلَكَ ذَا رَحِمٍ فَهُوَ حُرٌّ»

Translation

✧ “Whoever owns an unmarriageable kin relative, he is free.” Qatadah used to act upon it. And from Qatadah that al-Hasan and Jabir b. Zayd said: “Whoever owns a kin relative, he is free.”
