أَخْبَرَنَا قُتَيْبَةُ بْنُ سَعِيدٍ حَدَّثَنَا اللَّيْثُ عَنِ ابْنِ شِهَابٍ عَنْ عُبَيْدِ اللهِ بْنِ عَبْدِ اللهِ بْنِ عُتْبَةَ

عَنْ أَبِي هُرَيْرَةَ وَزِيدِ بْنِ خَالِدٍ أَنَّهُمَا قَالَا إِنَّ رَجُلًا مِنَ الْأَعْرَابِ أَتَى رَسُولَ اللهِ ﷺ فَقَالَ يَا رَسُولَ اللهِ أَنْشُدُكَ إِلَّا قَضَيْتَ لِي بِكَتَابِ اللهِ فَقَالَ الْخَصْمُ الْآخَرُ وَهُوَ أَفْقَهُ مِنْهُ نَعَمْ وَاقْضِ بَيْنَنَا بِكَتَابِ اللهِ وَائْذَنْ لِي فَقَالَ رَسُولُ اللهِ ﷺ «قُلْ» فَقَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ وَإِنِّي أُخْبِرْتُ أَنَّ عَلَى ابْنِي الرَّجْمُ فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَبِوَلِيدَةٍ فَسَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي جَلْدَ مِائَةٍ وَتَغْرِيبَ عَامٍ وَأَنَّ عَلَى امْرَأَةِ هَذَا الرَّجْمَ فَقَالَ رَسُولُ اللهِ ﷺ «وَالَّذِي نَفْسِي بِيَدِهِ لَأَقْضِيَنَّ بَيْنَكُمَا بِكَتَابِ اللهِ الْوَلِيدَةُ وَالْغَنَمُ رَدٌّ وَعَلَى ابْنِكَ جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ اغْدُ يَا أُنَيْسُ إِلَى امْرَأَةِ هَذَا فَارْجُمْهَا» فَغَدَا عَلَيْهَا فَاعْتَرَفَتْ فَأَمَرَ بِهَا فَرُجِمَتْ

✧ From Abu Hurayrah and Zayd b. Khalid that they said: A man from the Bedouins came to the Messenger of Allah ﷺ and said: O Messenger of Allah, I adjure you by Allah to judge for me according to the Book of Allah. The other litigant, who was more knowledgeable than him, said: Yes, judge between us according to the Book of Allah and permit me. The Messenger of Allah ﷺ said: “Speak.” He said: My son was a laborer for this man, and he committed adultery with his wife. I was told that my son is subject to stoning, so I ransomed him with one hundred sheep and a slave girl. Then I asked the people of knowledge, and they informed me that my son is subject to one hundred lashes and exile for a year, and that the wife of this man is subject to stoning. The Messenger of Allah ﷺ said: “By the One in Whose hand is my soul, I will judge between you according to the Book of Allah. The slave girl and the sheep are to be returned, and your son is subject to one hundred lashes and exile for a year. Go, O Unays, to this man's wife and stone her.” So he went to her and she confessed, and he ordered her and she was stoned.
