حَدَّثَنَا يُونُسُ بْنُ عَبْدِ الْأَعْلَى، وَمُحَمَّدُ بْنُ عَبْدِ اللهِ بْنِ عَبْدِ الْحَكَمِ قَالَا: حَدَّثَنَا ابْنُ وَهْبٍ، [قَالَ ]: أَخْبَرَنِي جَرِيرُ بْنُ حَازِمٍ، عَنْ سُلَيْمَانَ بْنِ مِهْرَانَ، عَنْ أَبِي ظِبْيَانَ، عَنِ ابْنِ عَبَّاسٍ قَالَ:

مَرَّ عَلِيُّ بْنُ أَبِي طَالِبٍ بِمَجْنُونَةِ بَنِي فُلَانٍ قَدْ زَنَتْ، أَمَرَ عُمَرُ بِرَجْمِهَا، فَرَدَّهَا عَلِيٌّ، وَقَالَ لِعُمَرَ: يَا أَمِيرَ الْمُؤْمِنِينَ، أَتَرْجُمُ هَذِهِ ؟ قَالَ: نَعَمْ، قَالَ: أَمَا تَذْكُرُ أَنَّ رَسُولَ اللهِ ﷺ قَالَ: رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ: عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ "، قَالَ: صَدَقْتَ، فَخَلَّى عَنْهَا

✧ ʿAli b. Abi Talib passed by a madwoman of Banu So-and-so who had committed adultery. ʿUmar had ordered her to be stoned. ʿAli turned her away and said to ʿUmar: "O Commander of the Faithful, would you stone this one?" He said: "Yes." He said: "Do you not remember that the Messenger of God ﷺ said: 'The pen is lifted from three: from the insane person whose mind is overcome, from the sleeping person until he wakes, and from the child until he reaches puberty'?" He said: "You have spoken the truth." So he released her.
