أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُعَافِي الْعَابِدُ بِصَيْدَا أَخْبَرَنَا مَحْمُودُ بْنُ خَالِدٍ الدِّمَشْقِيُّ حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ حَدَّثَنَا أَبُو مُعَيْدٍ حَفْصُ بْنُ غَيْلَانَ الْهَمْدَانِيُّ عَنْ سُلَيْمَانَ بْنِ مُوسَى عَنْ نَافِعٍ عَنِ ابْنِ عُمَرَ وَعَنْ عَطَاءٍ عَنْ جَابِرٍ أَنَّ رَسُولَ اللَّهِ ﷺ قَالَ

«مَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَلَهُ مَالُهُ وَعَلَيْهِ دَيْنُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنْ أَبَّرَ نَخْلًا فَبَاعَهُ بَعْدَ تَأْبِيرِهِ فَلَهُ ثَمَرُهُ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ»

✧ «Whoever buys a slave who has property, then the property belongs to him, and upon him is the slave's debt, unless the buyer stipulates otherwise. And whoever pollinates palm trees and then sells them after their pollination, the fruit belongs to him, unless the buyer stipulates otherwise.»
