✧ Whoever frees a share in a slave, he is responsible for completing the freeing of the slave from his own wealth if he has wealth. If he has no wealth, the slave is assessed at a fair value, then the slave is required to work to earn the share of the one who did not free him, without being overburdened.

  • Dāraquṭnī

machine translationHishām al-Dastuwāʾī agreed with him and did not mention istisʿāyah. Shuʿbah and Hishām are the best memorizers of those who narrated it from Qatādah. Hammām narrated it and made istisʿāyah the statement of Qatādah, separating it from the words of the Prophet ﷺ. Ibn Abī ʿArūbah and Jarīr b. Ḥāzim narrated it from Qatādah and made istisʿāyah part of the statement of the Prophet ﷺ. I think they both erred in it, because Shuʿbah, Hishām and Hammām contradicted them.

machine translationThis is a hadith that revolves around Qatādah, from al-Naḍr b. Anas, from Bashīr b. Nahīk, from Abū Hurayrah. The students of Qatādah differed concerning him about the requirement that the slave work to earn his freedom (istisʿāyah), which is the point that contradicts the hadith of Ibn ʿUmar in the narration of Mālik and others. Shuʿbah and Hammām agreed on omitting the mention of working for freedom (siʿāyah) in this hadith, and the statement is theirs regarding Qatādah according to all the people of knowledge of hadith, when others contradict them concerning Qatādah. The students of Qatādah who are authoritative regarding him are these three. If these three agree, no attention is paid to whoever contradicts them regarding Qatādah. If they differ, it is examined: if two of them agree and one is alone, then the statement is that of the two, especially if one of them is Shuʿbah, and no one in general is like Shuʿbah regarding Qatādah, because he would make him stop and verify the chain and the hearing. Shuʿbah and Hishām agreed in this hadith on the omission of the mention of istisʿāyah, and Hammām followed them. In this is a strengthening of the hadith of Ibn ʿUmar, which is a sound (ṣaḥīḥ) Medinan hadith that no other is measured against, and it is the most worthy of what is said in this chapter.
