أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ بْنِ خُزَيْمَةَ قَالَ حَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيِّ عَنْ سُفْيَانَ عَنْ فِرَاسٍ عَنِ الشَّعْبِيِّ عَنْ مَسْرُوقٍ عَنْ عَبْدِ اللَّهِ

فِي رَجُلٍ تَزَوَّجَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يَفْرِضْ فَقَالَ لَهَا الصَّدَاقُ كَامِلًا وَعَلَيْهَا الْعِدَّةُ وَلَهَا الْمِيرَاثُ قَالَ مَعْقِلُ بْنُ سِنَانٍ «شَهِدْتُ رَسُولَ اللَّهِ ﷺ قَضَى بِهِ فِي بِرْوَعَ بِنْتِ وَاشِقٍ»

✧ Regarding a man who married but had not consummated the marriage and had not stipulated a dower, he said: She is entitled to the full dower, she must observe the waiting period, and she inherits. Ma'qil b. Sinan said, "I witnessed the Messenger of Allah ﷺ rule this in the case of Birwa' bt. Washiq."
