حَدَّثَنَا ابْنُ فُضَيْلٍ، عَنْ بَسَّامٍ، عَنْ فُضَيْلٍ قَالَ: قَالَ إِبْرَاهِيمُ
فِي رَجُلٍ تَرَكَ جَدَّهُ، وَأُخْتَهُ لِأَبِيهِ وَأُمِّهِ، وَأَخَاهُ لِأَبِيهِ، فَلِلْجَدِّ فِي قَضَاءِ زَيْدٍ الْخُمُسَانِ مِنْ عَشَرَةٍ: أَرْبَعَةُ أَسْهُمٍ، وَلِأُخْتِهِ مِنْ أَبِيهِ وَأُمِّهِ النِّصْفُ خَمْسَةٌ، وَلِأَخِيهِ لِأَبِيهِ سَهْمٌ، [يَرُدُّ ] [١]الْأَخُ مِنَ الْأَبِ فِي قَضَاءِ زَيْدٍ عَلَى الْأُخْتِ مِنَ الْأَبِ وَالْأُمِّ، كَانَ لَهَا ثَلَاثَةُ أَخْمَاسِ الْمَالِ، فَأُعْطِيَتِ النِّصْفَ مِنْ أَجْلِ أَنَّ ثَلَاثَةَ أَخْمَاسٍ أَكْثَرُ مِنَ النِّصْفِ، وَلَيْسَ لِلْأُخْتِ الْوَاحِدَةِ وَإِنْ قَاسَمَهَا [٢]أَكْثَرُ مِنَ النِّصْفِ
