حَدَّثَنَا يُونُسُ بْنُ مُحَمَّدٍ حَدَّثَنَا أَبُو عَوَانَةَ عَنْ مُغِيرَةَ عَنْ حَمَّادٍ

فِي الرَّجُلِ يَكُونُ لَهُ ثَلَاثَةُ بَنِينَ فَقَالَ ثُلُثِي لِأَصْغَرِ بَنِيَّ فَقَالَ الْأَوْسَطُ أَنَا أُجِيزُ وَقَالَ الْأَكْبَرُ أَنَا لَا أُجِيزُ قَالَ «هِيَ مِنْ تِسْعَةٍ يُخْرِجُ ثُلُثَهُ فَلَهُ سَهْمُهُ وَسَهْمُ الَّذِي أَجَازَ» وَقَالَ حَمَّادٌ «يَرُدُّ السَّهْمَ عَلَيْهِمْ جَمِيعًا» وَقَالَ عَامِرٌ «الَّذِي رَدَّ إِنَّمَا رَدَّ عَلَى نَفْسِهِ»

✧ About a man who had three sons and said, 'Two thirds of my property are for the youngest of my sons.' The middle one said, 'I approve it,' and the eldest said, 'I do not approve it.' He said, 'It is from nine: he takes out his third, so he gets his share and the share of the one who approved.' Hammad said, 'He returns the share to all of them.' Amir said, 'The one who rejected only rejected against himself.'
