حَدَّثَنَا أَبُو بَكْرٍ النَّيْسَابُورِيُّ وَمُحَمَّدُ بْنُ مَخْلَدٍ وَآخَرُونَ قَالُوا نا عَلِيُّ بْنُ حَرْبٍ نا عَبْدُ اللَّهِ بْنُ إِدْرِيسَ عَنِ ابْنِ جُرَيْجٍ عَنْ أَبِي الزُّبَيْرِ عَنْ جَابِرٍ قَالَ

قَضَى رَسُولُ اللَّهِ ﷺ فِي الشُّفْعَةِ فِي كُلِّ شِرْكٍ لَمْ يُقْسَمْ رَبْعَةٌ أَوْ حَائِطٌ لَا يَحِلُّ لَهُ أَنْ يَبِيعَهُ حَتَّى يَسْتَأْذِنَ شَرِيكَهُ وَقَالَ ابْنُ مَخْلَدٍ حَتَّى يُؤَذِنَ شَرِيكَهُ فَإِنْ شَاءَ أَخَذَ وَإِنْ شَاءَ تَرَكَ فَإِنْ بَاعَهُ وَلَمْ يُؤْذِنْهُ فَهُوَ أَحَقُّ بِهِ
