أنا مُحَمَّدُ بْنُ إِسْمَاعِيلَ الْفَارِسِيُّ نا إِسْحَاقُ بْنُ إِبْرَاهِيمَ بْنِ عَبَّادٍ نا عَبْدُ الرَّزَّاقِ عَنِ ابْنِ عُيَيْنَةَ عَنْ عَمْرِو بْنِ دِينَارٍ عَنْ طَاوُسٍ عَنِ ابْنِ عَبَّاسٍ قَالَ
قَامَ عُمَرُ بْنُ الْخَطَّابِ ؓ عَلَى الْمِنْبَرِ فَقَالَ أُذَكِّرُ اللَّهَ امْرَأً سَمِعَ رَسُولَ اللَّهِ ﷺ قَضَى فِي الْجَنِينِ فَقَامَ حَمَلُ بْنُ مَالِكِ بْنِ النَّابِغَةِ الْهُذَلِيُّ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ كُنْتُ بَيْنَ جَارِيَتَيْنِ يَعْنِي ضَرَّتَيْنِ فَجَرَحَتْ أَوْ ضَرَبَتْ إِحْدَاهُمَا الْأُخْرَى بِمِسْطَحِ عَمُودٍ ظَلَّتْهَا فَقَتَلَتْهَا وَقَتَلَتْ مَا فِي بَطْنِهَا فَقَضَى النَّبِيُّ ﷺ فِي الْجَنِينِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ فَقَالَ عُمَرُ اللَّهُ أَكْبَرُ لَوْ لَمْ نَسْمَعْ هَذِهِ الْقَضِيَّةَ لَقَضَيْنَا بِغَيْرِهِ
