If he makes a contract of emancipation (kitābah) while he has no child, and then children are born to him from his concubine, and their father dies, nothing is deducted from them, and they remain bound by their father's contract if they wish; and if they prefer, their father's contract is cancelled and they are slaves of his owner. Thus they said. But we say: when the contracted slave (mukātab), male or female, dies before paying the contract money, they die as slaves, and their children are slaves, inferring from what has preceded concerning the mukātab, that he is a slave as long as a single dirham remains owing from him.
