( أَخْبَرَنَا ) أَبُو سَعِيدِ بْنُ أَبِي عَمْرٍو، ثَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أَنْبَأَ الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنْبَأَ الشَّافِعِيُّ، أَنْبَأَ مَالِكٌ، عَنِ ابْنِ شِهَابٍ:
أَنَّ مَرْوَانَ بْنَ الْحَكَمِ أُتِيَ بِإِنْسَانٍ قَدِ اخْتَلَسَ مَتَاعًا فَأَرَادَ قَطْعَ يَدِهِ فَأَرْسَلَ إِلَى زَيْدِ بْنِ ثَابِتٍ فَسَأَلَهُ، عَنْ ذَلِكَ فَقَالَ زَيْدٌ: لَيْسَ فِي الْخُلْسَةِ قَطْعٌ
