✧ The Irrevocably Divorced Woman Has No Maintenance Unless She Is Pregnant

( وَقَدْ أَخْبَرَنَا ) أَبُو بَكْرٍ: أَحْمَدُ بْنُ الْحَسَنِ الْقَاضِي، أَنَا أَبُو الْعَبَّاسِ مُحَمَّدُ بْنُ يَعْقُوبَ، أَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنَا الشَّافِعِيُّ، أَنَا إِبْرَاهِيمُ بْنُ أَبِي يَحْيَى عَنْ عَمْرِو بْنِ مَيْمُونِ بْنِ مِهْرَانَ عَنْ أَبِيهِ قَالَ:

قَدِمْتُ الْمَدِينَةَ فَسَأَلْتُ عَنْ أَعْلَمِ أَهْلِهَا فَدُفِعْتُ إِلَى سَعِيدِ بْنِ الْمُسَيِّبِ فَسَأَلْتُهُ عَنِ الْمَبْتُوتَةِ فَقَالَ: تَعْتَدُّ فِي بَيْتِ زَوْجِهَا. فَقُلْتُ: فَأَيْنَ حَدِيثُ فَاطِمَةَ بِنْتِ قَيْسٍ ؟ فَقَالَ: هَاهْ وَوَصَفَ أَنَّهُ تَغَيَّظَ وَقَالَ: فَتَنَتْ فَاطِمَةُ النَّاسَ، كَانَتْ بِلِسَانِهَا ذَرَابَةٌ فَاسْتَطَالَتْ عَلَى أَحْمَائِهَا، فَأَمَرَهَا رَسُولُ اللهِ ﷺ أَنْ تَعْتَدَّ فِي بَيْتِ ابْنِ أُمِّ مَكْتُومٍ.
