✧ Whoever says the one who takes an oath of continence is waited for after four months; if he returns, otherwise he divorces

( وَأَخْبَرَنَا ) أَبُو زَكَرِيَّا: يَحْيَى بْنُ إِبْرَاهِيمَ، نَا أَبُو الْعَبَّاسِ: مُحَمَّدُ بْنُ يَعْقُوبَ، أَنَا الرَّبِيعُ بْنُ سُلَيْمَانَ، أَنَا الشَّافِعِيُّ، أَنَا سُفْيَانُ عَنْ أَبِي الزِّنَادِ عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ قَالَ:

كَانَتْ عَائِشَةُ ؓ إِذَا ذُكِرَ لَهَا الرَّجُلُ يَحْلِفُ أَنْ لَا يَأْتِيَ امْرَأَتَهُ فَيَدَعُهَا خَمْسَةَ أَشْهُرٍ لَا تَرَى ذَلِكَ شَيْئًا حَتَّى يُوقَفَ، وَتَقُولُ: كَيْفَ قَالَ اللهُ عَزَّ وَجَلَّ: فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ
