It was the opinion of Abū Bakr and ʿUmar (may God be pleased with them) that they would make the grandfather take precedence over the brother. ʿUmar disliked speaking about it. When ʿUmar himself became a grandfather, he said: "This is a matter that has come to pass, and the people must know it." So he sent for Zayd b. Thābit and asked him. He said: "It was the opinion of Abū Bakr (may God be pleased with him) that we make the grandfather take precedence over the brother." He said: "O Commander of the Believers, do not treat it as a tree that grew, and a branch split off from it, and then a branch split off within that branch. How can the first branch be made to take precedence over the second branch, when the branch has come out of the branch?" He said: So he sent for ʿAlī (may God be pleased with him) and asked him, and he told him as Zayd had said, except that he made it a torrent that flowed, from which one channel split off, and then two channels split off from it. He said: "Do you see, if this middle channel were to return, would it not go to both channels together?" Then ʿUmar (may God be pleased with him) stood and addressed the people, saying: "Is there anyone among you who heard the Messenger of God ﷺ mention the grandfather in an inheritance case?" A man stood and said: "I heard the Messenger of God ﷺ when an inheritance case was mentioned to him in which the grandfather was mentioned, and he gave him the third." He said: "Who were the other heirs with him?" He said: "I do not know." He said: "May you not know!" Then he addressed the people again and said: "Is there anyone among you who heard the Messenger of God ﷺ mention the grandfather in an inheritance case?" A man stood and said: "I heard the Prophet ﷺ when an inheritance case was mentioned to him in which the grandfather was mentioned, and the Messenger of God ﷺ gave him the sixth." He said: "Who were the other heirs with him?" He said: "I do not know." He said: "May you not know!" (Al-Shaʿbī said): Zayd b. Thābit used to treat him as a brother until they reached three, with him being the third of them; if they exceeded that, he gave him the third. ʿAlī b. Abī Ṭālib (may God be pleased with him) used to treat him as a brother until they reached six, with him being the sixth of them; if they exceeded that, he gave him the sixth.
