وَأَخْبَرَنَا ) أَبُو الْحَسَنِ الرَّفَّاءُ، أَنَا عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثَنَا إِسْمَاعِيلُ الْقَاضِي، ثَنَا ابْنُ أَبِي أُوَيْسٍ، وَعِيسَى بْنُ مِينَاءَ، قَالَا: ثَنَا ابْنُ أَبِي الزِّنَادِ، عَنِ الْفُقَهَاءِ مِنْ أَهْلِ الْمَدِينَةِ، كَانُوا يَقُولُونَ:
كُلُّ قَوْمٍ مُتَوَارِثِينَ مَاتُوا فِي هَدْمٍ أَوْ غَرَقٍ، أَوْ حَرِيقٍ، أَوْ غَيْرِهِ، فَعَمِيَ مَوْتُ بَعْضِهِمْ قَبْلَ بَعْضٍ، فَإِنَّهُمْ لَا يَتَوَارَثُونَ، وَلَا يَحْجُبُونَ، وَعَلَى ذَلِكَ كَانَ قَوْلُ زَيْدِ بْنِ ثَابِتٍ، وَقَضَى بِذَلِكَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ
