A woman in Medina granted her son a life-tenure (ʿumrā) in an orchard of hers. Then he died, and she died after him. He left a child, and he had brothers, the sons of the woman who had granted the tenure. The children of the grantor said: "The orchard has returned to us." The sons of the grantee said: "Rather it belonged to our father in his life and in his death." They brought their dispute to Ṭāriq, the freed slave of ʿUthmān, and he summoned Jābir, who testified that the Prophet ﷺ ruled that a life-tenure (ʿumrā) belongs to the one it was granted to. Ṭāriq ruled accordingly. Then he wrote to ʿAbd al-Malik and informed him of that, and informed him of Jābir's testimony. ʿAbd al-Malik said: "Jābir has spoken truly." And Ṭāriq enforced that, so that orchard belongs to the sons of the grantee to this day.
