وَمِنْهَا مَا أَخْبَرَنَا أَبُو الْقَاسِمِ: عَبْدُ الْخَالِقِ بْنُ عَلِيِّ بْنِ عَبْدِ الْخَالِقِ الْمُؤَذِّنُ، أَنْبَأَ بَكْرُ بْنُ مُحَمَّدِ بْنِ حَمْدَانَ الْمَرْوَزِيُّ، ثَنَا أَبُو قِلَابَةَ: عَبْدُ الْمَلِكِ بْنُ مُحَمَّدٍ الرَّقَاشِيُّ، ثَنَا الضَّحَّاكُ بْنُ مَخْلَدٍ الشَّيْبَانِيُّ، ثَنَا مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، وَأَبِي سَلَمَةَ، عَنْ أَبِي هُرَيْرَةَ، قَالَ:

قَضَى رَسُولُ اللهِ ﷺ بِالشُّفْعَةِ فِيمَا لَمْ يُقْسَمْ، فَإِذَا حُدَّتِ الْحُدُودُ، وَصُرِفَتِ الطُّرُقُ فَلَا شُفْعَةَ
