( أَخْبَرَنَا ) أَبُو الْحَسَنِ عَلِيُّ بْنُ مُحَمَّدِ بْنِ يُوسُفَ الْبَغْدَادِيُّ، أَنَا عُثْمَانُ بْنُ مُحَمَّدِ بْنِ بِشْرٍ، ثَنَا إِسْمَاعِيلُ الْقَاضِي، ثَنَا ابْنُ أَبِي أُوَيْسٍ، ثَنَا ابْنُ أَبِي الزِّنَادِ عَنْ أَبِيهِ عَنِ الْفُقَهَاءِ الَّذِينَ يُنْتَهَى إِلَى قَوْلِهِمْ مِنْ أَهْلِ الْمَدِينَةِ كَانُوا يَقُولُونَ:
إِذَا تَبَايَعَ الرَّجُلَانِ بِالْبَيْعِ وَاخْتَلَفَا فِي الثَّمَنِ احْتَلَفَا جَمِيعًا، فَأَيُّهُمَا نَكَلَ لَزِمَهُ الْقَضَاءُ، فَإِنْ حَلَفَا جَمِيعًا كَانَ الْقَوْلُ مَا قَالَ الْبَائِعُ، وَخُيِّرَ الْمُبْتَاعُ إِنْ شَاءَ أَخَذَ بِذَلِكَ الثَّمَنِ وَإِنْ شَاءَ تَرَكَ
