( وَأَخْبَرَنَا ) أَبُو زَكَرِيَّا بْنُ أَبِي إِسْحَاقَ الْمُزَكِّي، أَنَا أَبُو عَبْدِ اللهِ مُحَمَّدُ بْنُ يَعْقُوبَ، ثَنَا مُحَمَّدُ بْنُ عَبْدِ الْوَهَّابِ، ثَنَا جَعْفَرُ بْنُ عَوْنٍ، أَنَا ابْنُ أَبِي ذِئْبٍ عَنْ مَخْلَدِ بْنِ خُفَافٍ قَالَ:

كَانَ بَيْنِي وَبَيْنَ شُرَكَائِي عَبْدٌ، فَاقْتَوَيْنَاهُ فِيمَا بَيْنَنَا، قَالَ: وَكَانَ مِنْهُمْ غَائِبٌ، فَقَدِمَ، فَخَاصَمَنَا إِلَى هِشَامٍ، فَقَضَى أَنْ يُرَدَّ الْعَبْدُ وَخَرَاجُهُ، وَقَدْ كَانَ اجْتَمَعَ مِنْ خَرَاجِهِ أَلْفُ دِرْهَمٍ. قَالَ: فَأَتَيْتُ عُرْوَةَ فَأَخْبَرْتُهُ، فَأَخْبَرَنِي عُرْوَةُ عَنْ عَائِشَةَ أَنَّ رَسُولَ اللهِ ﷺ قَضَى بِالْخَرَاجِ بِالضَّمَانِ، قَالَ: فَأَتَيْتُ هِشَامًا فَأَخْبَرْتُهُ، قَالَ: فَرَدَّ ذَلِكَ وَأَجَازَهُ
