قَالَ وَجَدْتُ فِي كِتَابِ أَبِي حَدَّثَنَا يَزِيدُ أَخْبَرَنَا شُعْبَةُ عَنْ أَبِي إِسْحَاقَ عَنْ رَجُلٍ مِنْ نَجْرَانَ

أَنَّهُ سَأَلَ ابْنَ عُمَرَ فَقَالَ: إِنَّمَا أَسْأَلُكَ عَنِ اثْنَتَيْنِ: عَنِ الزَّبِيبِ وَالتَّمْرِ، وَعَنِ السَّلَمِ فِي النَّخْلِ، فَقَالَ ابْنُ عُمَرَ: أُتِيَ رَسُولُ اللهِ ﷺ بِرَجُلٍ سَكْرَانَ فَقَالَ: إِنَّمَا شَرِبْتُ زَبِيبًا وَتَمْرًا، قَالَ: فَجَلَدَهُ الْحَدَّ وَنَهَى عَنْهُمَا أَنْ يُجْمَعَا، قَالَ: وَأَسْلَمَ رَجُلٌ فِي نَخْلٍ لِرَجُلٍ، فَقَالَ: لَمْ تَحْمِلْ نَخْلُهُ ذَلِكَ الْعَامَ، فَأَرَادَ أَنْ يَأْخُذَ دَرَاهِمَهُ فَلَمْ يُعْطِهِ فَأَتَى بِهِ رَسُولَ اللهِ ﷺ فَقَالَ: لَمْ تَحْمِلْ نَخْلُهُ، قَالَ: لَا، قَالَ: فَفِيمَ تَحْبِسُ دَرَاهِمَهُ ؟ قَالَ: فَدَفَعَهَا إِلَيْهِ، قَالَ: وَنَهَى رَسُولُ اللهِ ﷺ عَنِ السَّلَمِ فِي النَّخْلِ حَتَّى يَبْدُوَ صَلَاحُهُ.

Translation

✧ That he asked Ibn Umar, saying: I only ask you about two things: about raisins and dates, and about salaf in palm trees. Ibn Umar said: A drunk man was brought to the Messenger of Allah ﷺ and he said: I only drank raisins and dates. He said: He gave him the prescribed punishment and forbade combining them. He said: And a man paid in advance for palm trees of another man. He said: His palm trees did not bear fruit that year. So he wanted to take back his dirhams but he did not give them to him. He brought him to the Messenger of Allah ﷺ and he said: His palm trees did not bear fruit. He said: No. He said: So why do you withhold his dirhams? He said: So he gave them back to him. He said: And the Messenger of Allah ﷺ forbade salaf in palm trees until their goodness becomes apparent.
