قَرَأْتُ عَلَى يَحْيَى بْنِ سَعِيدٍ عَنْ هِشَامٍ حَدَّثَنَا قَتَادَةُ عَنْ خِلَاسٍ عَنْ عَبْدِ اللهِ بْنِ عُتْبَةَ قَالَ أُتِيَ عَبْدُ اللهِ بْنُ مَسْعُودٍ فَسُئِلَ
أُتِيَ عَبْدُ اللهِ بْنُ مَسْعُودٍ، فَسُئِلَ عَنْ رَجُلٍ تَزَوَّجَ امْرَأَةً، وَلَمْ يَكُنْ سَمَّى لَهَا صَدَاقًا، فَمَاتَ قَبْلَ أَنْ يَدْخُلَ بِهَا؟ فَلَمْ يَقُلْ فِيهَا شَيْئًا، فَرَجَعُوا، ثُمَّ أَتَوْهُ فَسَأَلُوهُ؟ فَقَالَ: سَأَقُولُ فِيهَا بِجَهْدِ رَأْيِي، فَإِنْ أَصَبْتُ فَاللهُ عَزَّ وَجَلَّ يُوَفِّقُنِي لِذَلِكَ، وَإِنْ أَخْطَأْتُ فَهُوَ مِنِّي، لَهَا صَدَاقُ نِسَائِهَا، وَلَهَا الْمِيرَاثُ وَعَلَيْهَا الْعِدَّةُ، فَقَامَ رَجُلٌ مِنْ أَشْجَعَ فَقَالَ: أَشْهَدُ عَلَى النَّبِيِّ ﷺ أَنَّهُ قَضَى بِذَلِكَ، قَالَ: هَلُمَّ مَنْ يَشْهَدُ لَكَ بِذَلِكَ فَشَهِدَ أَبُو الْجَرَّاحِ بِذَلِكَ
Translation

✧ Abdullah b. Masud was approached and asked about a man who married a woman without specifying a dower for her, and he died before consummating the marriage. He did not say anything about it, so they left. Then they came to him and asked him again. He said: “I will give my best judgment. If I am right, it is from Allah, Mighty and Majestic, who grants me success; if I err, it is from me and from Satan. She is entitled to a dower like that of her peers, she inherits, and she must observe the waiting period.” A man from Ashjaʿ stood up and said: “I bear witness that the Prophet ﷺ ruled exactly that.” He said: “Bring someone who will testify with you.” Abu al-Jarrah testified to that.
