حَدَّثَنَا عَلِيُّ بْنُ عَاصِمٍ عَنْ خَالِدٍ عَنْ أَبِي قِلَابَةَ عَنْ عَبْدِ الرَّحْمَنِ بْنِ عَتَّابٍ قَالَ

كَانَ أَبُو هُرَيْرَةَ يَقُولُ: مَنْ أَصْبَحَ جُنُبًا فَلَا صَوْمَ لَهُ، قَالَ: فَأَرْسَلَنِي مَرْوَانُ بْنُ الْحَكَمِ أَنَا وَرَجُلٌ آخَرُ إِلَى عَائِشَةَ وَأُمِّ سَلَمَةَ نَسْأَلُهُمَا عَنِ الْجُنُبِ يُصْبِحُ فِي رَمَضَانَ قَبْلَ أَنْ يَغْتَسِلَ ؟ قَالَ: فَقَالَتْ إِحْدَاهُمَا: قَدْ كَانَ رَسُولُ اللهِ ﷺ يُصْبِحُ جُنُبًا، ثُمَّ يَغْتَسِلُ، وَيُتِمُّ صِيَامَ يَوْمِهِ، قَالَ: وَقَالَتِ الْأُخْرَى: كَانَ يُصْبِحُ جُنُبًا مِنْ غَيْرِ أَنْ يَحْتَلِمَ، ثُمَّ يُتِمُّ صَوْمَهُ، قَالَ: فَرَجَعَا فَأَخْبَرَا مَرْوَانَ بِذَلِكَ، فَقَالَ لِعَبْدِ الرَّحْمَنِ: أَخْبِرْ أَبَا هُرَيْرَةَ بِمَا قَالَتَا فَقَالَ أَبُو هُرَيْرَةَ: كَذَا كُنْتُ أَحْسِبُ، وَكَذَا كُنْتُ أَظُنُّ، قَالَ: فَقَالَ لَهُ مَرْوَانُ: بِالظَّنِّ وَبِأَحْسِبُ تُفْتِي النَّاسَ

Translation

✧ Abu Hurayrah used to say: Whoever wakes up in a state of major ritual impurity, there is no fasting for him. He said: Marwan b. al-Hakam sent me and another man to Aishah and Umm Salamah to ask them about a person who wakes up in Ramadan in a state of major ritual impurity before bathing. He said: One of them said: The Messenger of Allah ﷺ used to wake up in a state of major ritual impurity, then bathe, and complete his fast for the day. He said: And the other said: He used to wake up in a state of major ritual impurity without having had a wet dream, then complete his fast. He said: They returned and informed Marwan of that. He said to Abd al-Rahman: Inform Abu Hurayrah of what they said. Abu Hurayrah said: That is what I thought, and that is what I supposed. He said: Marwan said to him: With supposition and "I think" you give legal opinions to the people?
