حَدَّثَنَا إِسْحَاقُ بْنُ عِيسَى قَالَ حَدَّثَنِي لَيْثٌ قَالَ حَدَّثَنِي ابْنُ شِهَابٍ عَنْ عُرْوَةَعَنْ عَائِشَةَ

أَنَّ بَرِيرَةَ جَاءَتْ عَائِشَةَ تَسْتَعِينُهَا فِي كِتَابَتِهَا، وَلَمْ تَكُنْ قَضَتْ مِنْ كِتَابَتِهَا شَيْئًا، فَقَالَتْ لَهَا عَائِشَةُ: ارْجِعِي إِلَى أَهْلِكِ, فَإِنْ أَحَبُّوا أَنْ أَقْضِيَ عَنْكِ كِتَابَتَكِ، وَيَكُونُ وَلَاؤُكِ لِي فَعَلْتُ، فَذَكَرَتْ ذَلِكَ بَرِيرَةُ لِأَهْلِهَا فَأَبَوْا، وَقَالُوا: إِنْ شَاءَتْ أَنْ تَحْتَسِبَ عَلَيْكِ فَلْتَفْعَلْ، وَلْيَكُنْ لَنَا وَلَاؤُكِ. فَذَكَرْتُ ذَلِكَ لِرَسُولِ اللهِ ﷺ، فَقَالَ رَسُولُ اللهِ ﷺ: ابْتَاعِي فَأَعْتِقِي، فَإِنَّمَا الْوَلَاءُ لِمَنْ أَعْتَقَ. قَالَتْ: ثُمَّ قَامَ رَسُولُ اللهِ ﷺ فَقَالَ: مَا بَالُ أُنَاسٍ يَشْتَرِطُونَ شُرُوطًا لَيْسَتْ فِي كِتَابِ اللهِ عَزَّ وَجَلَّ، مَنِ اشْتَرَطَ شَرْطًا لَيْسَ فِي كِتَابِ اللهِ عَزَّ وَجَلَّ فَلَيْسَ لَهُ، وَإِنْ شَرَطَ مِائَةَ مَرَّةٍ، شَرْطُ اللهِ عَزَّ وَجَلَّ أَحَقُّ وَأَوْثَقُ

✧ Barirah came to Aishah seeking her help in her kitabah (contract of manumission), and she had not paid anything of her kitabah. Aishah said to her: Go back to your owners; if they like that I pay your kitabah and your wala' be mine, I will do it. Barirah mentioned that to her owners, but they refused and said: If she wishes to do you a favor, let her do it, but your wala' will be ours. She mentioned that to the Messenger of Allah ﷺ, and the Messenger of Allah ﷺ said: Buy her and set her free, for wala' belongs to the one who sets free. She said: Then the Messenger of Allah ﷺ stood up and said: What is the matter with people who stipulate conditions that are not in the Book of Allah, Mighty and Majestic? Whoever stipulates a condition that is not in the Book of Allah, Mighty and Majestic, it is not his, even if he stipulates it a hundred times. The condition of Allah, Mighty and Majestic, is more deserving and more binding.
