✧ The Surgeon and Abu Sinan al-Ashjaiyin

حَدَّثَنَا يَزِيدُ أَخْبَرَنَا سُفْيَانُ عَنْ مَنْصُورٍ عَنْ إِبْرَاهِيمَ عَنْ عَلْقَمَةَ قَالَ

أُتِيَ عَبْدُ اللهِ فِي امْرَأَةٍ تَزَوَّجَهَا رَجُلٌ فَتُوُفِّيَ عَنْهَا وَلَمْ يَفْرِضْ لَهَا صَدَاقًا، وَلَمْ يَكُنْ دَخَلَ بِهَا، قَالَ: فَاخْتَلَفُوا إِلَيْهِ، فَقَالَ: أَرَى لَهَا مِثْلَ صَدَاقِ نِسَائِهَا، وَلَهَا الْمِيرَاثُ، وَعَلَيْهَا الْعِدَّةُ. فَشَهِدَ مَعْقِلُ بْنُ سِنَانٍ الْأَشْجَعِيُّ أَنَّ رَسُولَ اللهِ ﷺ قَضَى فِي بَرْوَعَ بِنْتِ وَاشِقٍ بِمِثْلِ هَذَا.

✧ 'Abd Allah was asked about a woman whom a man married and then he died before assigning her a dower and before consummating the marriage. He said, 'They kept coming to him, and he said, "I think she is entitled to the like of the dower of her peers, and she inherits, and she must observe the waiting period."' Ma'qil b. Sinan al-Ashja'i testified that the Messenger of God ﷺ ruled in the case of Barwa' bint Washiq with the like of this.
